General Terms and Conditions for Internet hiring

Recitals

These General Conditions for Rental govern the conditions for rental and are applicable to any service order placed by an individual on the Website www.snowrental.com.

Our companies, the "Compagnie Francaise des Loueurs de Ski", and the "Compagnie Internationale des Loueurs de Ski", La Compagnie Européenne des Loueurs de Ski, hereinafter referred to as CFLS, CILS and CELS, guarantee the rental of winter sports equipment via the Internet, which is issued through ski rental shops operating in the Snowrental Network.

For the Skiset shops
CFLS rents winter sports equipment to customers who live in France and ski in France. CILS rents winter sports equipment to i) customers living abroad and skiing in France, ii) clients living abroad or skiing abroad, iii) customers living in France but skiing abroad).

For the Netski shops and Go Sport Montagne shops
CELS rents winter sports equipment to customers who live in France and ski in France and customers living abroad and skiing in France. CILS rents winter sports equipment to i) clients living abroad or skiing abroad, ii) customers living in France but skiing abroad).

CFLS rents winter sports equipment to customers who live in France and ski in France. CILS rents winter sports equipment to i) customers living abroad and skiing in France, ii) clients living abroad or skiing abroad, iii) customers living in France but skiing abroad).

La Compagnie Française des Loueurs de Ski (hereinafter referred to as CFLS), a public limited company with capital of 315,000 euros, registered at the NANTERRE Register of Companies under the number B 401 734 892, with intra-Community VAT number: FR 58401734892, whose head office is located at 424 Bureaux de la Colline - 92210 SAINT CLOUD – FRANCE and whose legal representative is Philippe Koiransky, Managing Director;

La Compagnie Européenne des Loueurs de Ski (hereinafter referred to as CELS), a public limited company with capital of 100 000 euros, registered at the NANTERRE Register of Companies under the number 877 610 923, with intra-Community VAT number: FR96 877 610 923, whose head office is located at 424 Bureaux de la Colline - 92210 SAINT CLOUD – FRANCE and whose legal representative is SARL Cosinus K;

La Compagnie Internationale des Loueurs de Ski (hereinafter referred to as CILS) a public limited company with capital of CHF 100,000, registered at the Canton de VAUD Register of Companies under the number CH -550-1045051-8, whose head office is located at Chemin de la Prairie 5 A - 1007, Lausanne - SWITZERLAND and whose legal representative is Isabelle Bachmann, Administrator.

All reservations for board sports equipment rental on the website, snowrental.com, or by telephone at the Reservation Station implies acceptance of the general conditions specified below. The general conditions for rental can be modified; the applicable conditions are those in effect on our site on the date when the reservation was made.

Article 1: Booking an equipment hire

1 - 1: Rental Equipment

All of the equipment offered for rental is described on our site and it is specified that the customer can reserve one category of equipment.

1-2: Rental fees

The cost of rental depends on the category of the equipment reserved by the customer and the rental period chosen, in accordance with our rental prices indicated in step 2 under the "Reservations" heading on our site. Our prices are inclusive of tax at the rate in effect when the reservation is made.

Prices given in currencies other than euros and Swiss francs are provided for information only.

Additional information concerning the 7th day free

The offer applies for the France destination only.
The offer applies for all stays of 6 days and over and entitles you to a full day of equipment hire on request in store.
The 7th free day should be requested when collecting the equipment. Any request made after collection will result in the offer becoming void.
The offer concerns the same equipment as that rented on www.snowrental.com which appears on the exchange voucher.
In the event of opting for a breakage/theft guarantee when booking the equipment on www.snowrental.com, it applies to the 7th free day.

1-3: Payment method

The customer has the option of paying in euros or Swiss Francs by bank card, banker's cheque, or through PayPal or Adyen as indicated in sections A to C below:

A: Secure payment by credit/debit card in euros or swiss francs

Snowrental International concluded a service agreement with Adyen concerning e-commerce; an agreement.

This agreement is aimed at ensuring all of the functions required for managing a payment service and for the secured acquisition of payment on the Internet.

Adyen manages the security of exchanges and ensures the protection of secrets (decryption keys) and their management.

Only bank cards issued in France or within the international networks approved by GIE Cartes Bancaires are accepted.

Financial costs (bank charges in connection with the exchange rate, banking commission for payment transactions made outside the territory where the card was issued, and other banking commissions) that may be tied to payments by bank card will remain the customers' responsibility. These expenses correspond to the possible costs deducted exclusively by the customer's banking institution as a result of using the bank card.

Acceptance from the central bank card network makes the order that was validated by the customer on the website effective. In the event of a refusal by the central bank card network, our company reserves the right to cancel the reservation.

When making a payment, customers are automatically connected to the payment processing centre's server. Bank data, protected by encryption, do not transit through Snowrental International systems and are therefore not preserved by it.

B: Bank cheque payment

Snowrental International authorises payments for the rental of equipment by banker's cheque (clearable only in France) or Giro cheque for all reservations registered more than 20 days before the first day of rental.

Cheques must be made out in euros to "Commandes Internet - CFLS" and sent to the following address:

If the cheque is not received at least 15 days before the customer's start date, the payment for equipment rental must be made solely by bank card. If payment is not made by bank card, the reservation will be cancelled.

C: Secured payment through PayPal or Adyen

Snowrental International has concluded service agreements with PayPal and Adyen.

These agreements are aimed at ensuring all of the functions required for managing a payment service and for the secured acquisition of payment on the Internet.

PayPal and Adyen manage the security of exchanges and ensure the protection of secrets (decryption keys) and their management.

Financial costs (bank charges related to the exchange rate, banking commission, etc....) that might be tied to payments through PayPal or Adyen will remain the customers' responsibility.

1-4: Final Order

The reservation is completed and only becomes effective once Snowrental International collects payment, according to what was previously mentioned, of the total amount of the rental and receipt by the customer of an electronic message confirming the rental and which includes the Voucher to be printed and presented by the customer in the shop of choice.

Article 2: Making available and returning the rental equipment - Rental Period

Rental starts once the equipment is collected by the customer in the shop of choice until and including the day of return in conformance with the period indicated on the Voucher, printed by the customer and handed in to the shop of choice.

The equipment can be collected the day before the first day of ski rental as of 5:00 pm and be returned at the end of the last day of rental or the following day before 10 am.

For reservations made less than 48h in advance, the shop cannot guarantee the preparation of the equipment.

Any return of equipment after 10 am the day following the return scheduled on the Voucher, will result in invoicing by the shop concerned of a day's rental at the rates indicated in the shop.

The customer is entirely responsible for the board sports equipment once he/she takes possession of it. He/she will keep it and use it in a manner that a good father would, under all circumstances. Taking the rented equipment is the responsibility of the person who rented it.

If there is a delay in taking the rented equipment, the customer is responsible for notifying the shop concerned as soon as possible. We ask the shops concerned to keep the reserved equipment for the customer for 24 hours. Beyond this deadline, the equipment is put back for rental without any compensation being due to the customer.

It is essential to return the rented equipment to the store where it was taken.

Regardless of the reason, if equipment that is rented is not returned, the customer will be billed for the entire published price of new equipment in addition to the rental cost by the shop concerned. The customer may protect himself/herself from the risks of theft by subscribing to the “breakage/theft” insurance (Article 5) when making the reservation.

Article 3: Use of the hired equipment

The rented equipment is intended for the sole use of the customer and not for sub-rental, or for lending, even free of cost. The customer is the only judge of his/her capacity to use the rented equipment.

He/she certifies being capable of using the equipment that is rented and agrees to use it with caution, without danger to third parties, in conformance with the current regulations.

All equipment presented for rental is recognized to be in good condition and should be returned as such. The equipment is numbered or marked and should be returned with the same numbers and the same mark. In addition to the cost of rental, the cost of replacement or repair will be paid directly to the shop concerned if there is any damage, regardless of the cause, within a maximum limit of the cost of new equipment. The customer may protect himself/herself from the risks of damage by subscribing to the “breakage/theft” insurance (article 5) when making the reservation.

Article 4: Availability of the equipment for rent

Snowrental International cannot be held responsible for delays in delivering rented equipment when they are due to reasons beyond their control, especially in the event of accidents, delays in return of equipment from previous rentals, changes in regulations, acts of God, strikes, and so on.

Under such circumstances, Snowrental International will do its best to make equipment of equal or superior quality available to the customer according to the stocks available in the shop concerned. Otherwise, Snowrental International agrees to repay the customer. Reimbursement is either by credit to the bank card used for the transaction, or by banker's cheque if the customer paid by banker's cheque, or credit to the PayPal or Adyen account if the customer paid through PayPal or Adyen.

Article 5: Ski-Equipment Damage and Theft Guarantee (except ASC' clients)

When making the reservation, the customer can insure the rented equipment against damage (total or partial damage to the ski equipment) and theft (total or partial). The cost of this insurance depends on the category of the equipment reserved by the customer and the rental period chosen, according to the rates given below:

The ski equipment is not insured against being forgotten, lost, or exchanged at any time during the period of the rental.

Customer's obligations in case of loss::

  • In case the ski equipment is stolen, the customer will forward a receipt of the theft report made to the relevant authorities (the police, for example) to the shop where the equipment was hired.
  • In the event of damage to the ski equipment, the customer will bring the damaged equipment back to the shop where it was hired.

Article 6: Cancellation Policy

The customer has 14- days from the booking confirmation to cancel the reservation. If this period were to end on a Saturday, Sunday or on a bank or public holiday, it shall be extended to the next working day.

This cancellation right does not apply where the reservation is booked 14 days or less from to the scheduled pick-up.

6-1: Exercising the withdrawal right

In case of exercise of the withdrawal right within the 14-day cancellation period, the sums paid by the customer shall be refunded less an administrative charge of 1€ per person including taxes (except ASC' clients). The refund is made whether by crediting the card used for the transaction ; or by bank cheque if the customer paid by bank cheque or holiday cheque ; or by crediting the PayPal or Adyen account used for the transaction.

6-2: Cancellation before collecting the equipment and after the 7-day cancellation period during the following periods

  • All cancellation of hire until 5 days (included) before the beginning of the hire will result in the refund of the rental and the Ski Equipment Damage and theft guarantee if taken previously, less a 3% cancellation fee.
  • All cancellation of hire between 4 and 3 days (included) before the beginning of the hire will result in the refund of the rental and the Ski Equipment Damage and theft guarantee if taken previously, less a 50% cancellation fee.
  • Passed 3 days before the beginning of the hire, no cancellation shall be authorized and no refund shall be claimed.

Except for school holidays:

  • All cancellation of hire until 3 days (included) before the beginning of the hire will result in the refund of the rental and the Ski Equipment Damage and theft guarantee if taken previously, less a 3% cancellation fee.
  • All cancellation of hire until 2 days before the beginning of the hire will result in the refund of the rental and the Ski Equipment Damage and theft guarantee if taken previously, less a 50% cancellation fee.
  • Passed 2 days before the beginning of the hire, no cancellation shall be authorized and no refund shall be claimed.

6-3: Cancellation after collecting the equipment

In the event of illness or an accident occurring during the rental period, the rental conditions remain applicable. Only the equipment rented by the person concerned can be returned and will be invoiced pro rata for the actual number of days of rental (on presentation of a medical certificate and proof that the equipment delivered by the shop was returned).

In that case, the reimbursement (after deduction of the sum of €1 .00/ CHF 1.40 per person, inclusive of tax, for administrative costs) will be made by credit to the bank card used for the transaction, or by banker's cheque if the customer paid by banker's cheque or by credit to the PayPal or Adyen account if the customer paid through PayPal or Adyen. Any rental day commenced will not be subject to a refund.

6-4: Cancellation due to weather conditions

In the event the ski area normally accessible from the equipment rental location is totally closed, and only in this case, the rental days concerned will be refunded upon the presentation of written proof issued by the resort's lift company.

In that case, reimbursement will be either by the credit of the bank card used for the transaction, or by banker's cheque if the customer paid by banker's cheque, or credit to the PayPal or Adyen account if the customer paid through PayPal or Adyen.

Article 7: Personal Data

The customer should read the section on "Legal notices – personal data" on this site.

Article 8: Applicable Jurisdiction

In case of any dispute whatsoever concerning this contract, and failing an amicable agreement, the dispute will be settled by the competent Court according to the applicable procedural rules.

Only French law will be applicable to any lawsuit, regardless of the type, and only French courts will have jurisdiction.
